Are you a have you been paying your mortgage on time?


 California Rep. Jim Costa (D-Fresno) introduced a bill that will let responsible homeowners take advantage of current low interest rates on mortgages and allow them to stay in their homes. 



This was introduced to us from out C.A.R. President  LeFrancis Arnold
Please see the info below, this may help you to get your home refinanced. According to this program. 

“The Responsible Homeowner Refinancing Act” aims to remove barriers that keep homeowners from refinancing through the Home Affordable Refinance Program (HARP) and level the playing field to allow banks to compete for borrowers’ business.  Costa’s bill is the House companion to legislation introduced last May by Sens. Barbara Boxer (D-CA) and Robert Menendez (D-NJ).  “The Responsible Homeowner Refinancing Act of 2012" would streamline and align the refinance processes of Fannie Mae and Freddie Mac and make it easier for homeowners who are current on their mortgage payments but who have been previously unable to refinance to finally take advantage of record low interest rates.  C.A.R. thanks Mr. Costa for introducing this important legislation.

The Responsible Homeowner Refinancing Act of 2012
There are nearly 13.5 million responsible borrowers in loans guaranteed by Fannie Mae and Freddie 
Mac who could benefit from refinancing at today’s low interest rates.  Although recent changes to the 
Home Affordable Refinance Program (HARP) were a step in the right direction, they left in place barriers 
that will keep millions of borrowers trapped in higher interest loans.  The Responsible Homeowner 
Refinancing Act (H.R. 6428) will build on these changes and further expand opportunities to access 
historically low interest rates for borrowers who make their mortgage payments on time.  
To remove the barriers preventing borrowers who are making their payments on time from refinancing 
their loans at the lowest rates possible, the bill would:
Remove barriers to competition
Under HARP, lenders who want to compete with the borrower’s current lender for that borrowers’ 
business continue to face stricter underwriting criteria and greater risk that the GSEs will force them 
to buy that loan back should the borrower default.  These different standards have posed a barrier 
to competition, resulting in higher prices and less favorable terms for borrowers.  A recent study by 
Amherst Securities Group found that HARP borrowers are paying more than half a percentage point 
more than borrowers with other types of loans.
This bill would direct the GSEs to require the same streamlined underwriting and associated 
representations and warranties for new servicers as they do for current servicers, leveling the 
playing field and unlocking competition between banks for borrowers’ business.  
Guarantee equal access to streamlined refinancing for GSE borrowers

WASHINGTON --Since early 2010, a leading civil rights group has helped compile a database of approximately 26,000 complaints about mortgage modification scams -- attempts by fraudsters to take advantage of those hardest hit by the housing market meltdown.
The people making those complaints have reported losses of $63 million to the National Loan Modification Scam Database. And the Lawyers' Committee for Civil Rights Under Law, which manages the database, has filed 10 civil suits in conjunction with other organizations to try to halt mortgage assistance operations in California and New York.
The group said it was happy to hear that federal officials were cracking down on the scams with criminal charges, which adds another dimension to the fight in addition to civil fines.
“For some of these folks, the fines might be the cost of doing business,” said Yolanda McGill, senior counsel in the Fair Housing and Lending Project at the lawyers' group. “So the risk of jail time is important in all the efforts going on to stop this.”

As short sales become increasingly dominant in today’s market, so has short sale fraud, said short sale expert Kathy Mehringer.
“Fraud is heating up like a wildfire right now,” said Mehringer, risk management director and short sale advisor for Coldwell Banker Residential Brokerage in Sherman Oaks. “We’ve got to be aware that this fraud is changing directions, is jumping containment lines.”

Reports of mortgage fraud declined in the first half of 2012, but when looking at foreclosure-rescue scam reports alone, borrowers noted more suspicious activity, according to the Treasury's Financial Crimes Enforcement Network.

Foreclosure-rescue schemes generally target distressed borrowers, promising them a chance to obtain modifications for a fee; and in some cases, stripping the homeowner of their title by promising a fraudulent sale of the property to investors.
The Department of Justice reported Tuesday that a year-long initiative to fight foreclosure-rescue scammers netted well over 500 defendants. The accused defendants produced about $1 billion in potential losses. The Federal Trade Commission also filed lawsuits against three alleged mortgage relief fraudsters.

FinCen said Tuesday that 2,360 foreclosure-related suspicious activity reports were filed in the first half of 2012 alone.
"If this current pace continues, the total number of foreclosure-rescue scam suspicious activity reports for the calendar year will far exceed the total of 2,782 reported in 2011," FinCen wrote.

Yet, suspicious activity reports on mortgage fraud fell 41% from 2011 levels in the first half of the year. In fact, only 17,476 potential mortgage fraud reports were filed, according to FinCen.  Of those, 8%, or 1,325, involved potential foreclosure-rescue scams.

The state of California contains a disproportionate number of the suspicious activity reports related to foreclosure-rescue initiatives.

As for what might be causing an uptick in foreclosure scam reports, FinCen attributes this uptick to growing public awareness about the issue.

So here is some more info about the Consumer attitude by Fannie Mae.  Recent data shows that home prices are going up, inventory is low and rates are just about the lowest they have ever been!  

So the combination of all this factors should empower you the person that is on the fence to buy NOW, not tomorrow now!

WASHINGTON, DC – Results from Fannie Mae’s September 2012 National Housing Survey show Americans’ optimism about the recovery of the housing market and with regard to homeownership continued its gradual climb, bolstered by a series of mortgage rate decreases experienced throughout the summer. Consumer attitudes about the economy also improved substantially last month, breaking the progression of waning confidence seen during much of this year.
